PC §1001.95 Diversion: The Backstory presented by the Honorable Judge Daniel Lowenthal
On September 30, 2020, Governor Newsom signed Assembly Bill 3234 into law. The bill conferred judges with the discretion to offer diversion, over a prosecutor's objection, in most misdemeanor cases. It is the most expansive judicial diversion statute in the nation. Judge Lowenthal will briefly explain the legislative history of diversion in California and describe the process of writing AB 3234 and getting it enacted.
