Roadmap for Reproductive Rights: Litigation Updates In and Around Louisiana
In recent years, many of the country’s most extreme restrictions on abortion access—and highest-profile reproductive rights lawsuits—have come from Louisiana and its neighboring states. Louisiana abortion providers and patients won an important victory in 2020 when the Supreme Court struck down the state’s unconstitutional admitting privileges restriction, but Louisianians continue to face barriers to abortion access, with newly enacted restrictions prompting advocates to file additional litigation to defend abortion care in 2021.

Meanwhile, a ban on abortions at 6 weeks took effect in Texas in the beginning of September, prompting numerous legal challenges and oral arguments at the Supreme Court on November 1st. The Supreme Court will also hear oral arguments regarding Mississippi’s ban on abortions at 15 weeks in the case Dobbs v. Jackson Women’s Health Organization on December 1st, 2021 – the first time the Court will rule on the constitutionality of a pre-viability abortion ban since Roe.
