Jamie Liggins
34:58
Ok Derek... sounds good my next LIVE Webinar will be on March 15, 2021 on Field Inspector. The details are on www.notaryaccess.org on the Upcoming Events page
Lundria Blair
40:01
FL doesn't require one either, but I have always used one since I started in 2012. I also tell others to always have one even if youre notarizing something for a friend!
Davida

Delaware
Lakeisha Sutton
40:36
You are absolutely right Jamie
Lucia BoderoCruz
41:52
May I have the date for the webinar on Apostille? Thank you
Davida
41:57
I use the electronic journal.
Jamie Liggins
41:57
@ Denise Hibbert YES keep a journal on all notarizations
Christina Irizarry-Torres
43:11
where do I get an electronic journal?
Davida
44:07
I totally agree Jamie. I was just asked to to it yesterday. I didn’t. They sent it to me.
Laura Biewer CA
44:22
They can make it after and send it directly to the title company
Laura Biewer CA
44:34
This would not be notary law.
Christina Irizarry-Torres
44:34
I always get asked to do this?
Dr. Kerry Duskin
44:46
Christina you can use notaryact its in the app store. Be mindful of your state requirements as it is not allowed in AZ.
Aileen McGorty
44:50
where is the law on this ?
Aileen McGorty
45:13
a lot of title companies do tell me to do this.... I am very confused !
Aileen McGorty
45:25
ok so that is different
Aileen McGorty
46:17
I take a picture with phone and delete it in front of them
Davida
46:26
Signers don’t always do it even when you make that request.
Matt Miller
47:00
once you take that pic of the ID, you’re liable for the data. even if you delete it.
Davida
47:32
Also, with COVID-19 you should be screening them to make sure it is safe for you to enter their home.
Aileen McGorty
47:51
a lot of agencies made this a requirement to upload
Christina Irizarry-Torres
48:40
most of my signings don’t require a copy of the ID. Do you always make a copy?
Annie -Tennessee
49:00
So true, because with our automatic google photo cloud services, many times even when when we delete the photo, it has already gone to the cloud
Annie -Tennessee
49:29
And it can live in the cloud forever...lol
Matt Miller
49:53
is that ejournal connected to the internet in anyway? if so, you’re responsible for the data just like you are for your paper journal.
Davida
50:00
You can also print out the picture from the electronic journal.
Jamie Liggins
50:01
@Christinia Iri...If the company doesn't require a copy, I don't ask. It is required for Notaries to see and verify ID so that is paramount
Matt Miller
50:31
amrock will fire you if you use an ejoyrnal
Lisa Kadle
50:44
Agencies have said that they will deduct your fee if you do not send them a copy with the scan backs. How do you address that with the service?
Laura Biewer CA
51:44
You can use an ejournal in CA if it meets all the requirements for CA, such as thumbprint for Real Estate and POAs.
Jamie Liggins
52:24
@Lisa... scanbacks of the entire pkg are different than a scanned copy of the ID.
Si
52:28
do you recommend removing full pages from your journal so that you're not carrying around a book full of journal entries?
Jamie Liggins
52:40
No
Aileen McGorty
52:41
ok. there is no rule in my state that I cannot use my phone to take a picture..
Yvonne Sidell
52:44
@Laura, hmmmm didn't know about e-journals in CA...I wonder what type of e-thumbprinter to get to capture that print. :)
Christina Irizarry-Torres
54:38
Do you mean attaching a notarial certificate?
Clyde Heppner
55:02
@si check your state statutes, many require a bound journal with sequentially numbered pages
Clyde Heppner
55:52
@si as a standard of care, it is not recommended
Aileen McGorty
56:56
good tip!
Lundria Blair
01:00:11
on loan docs, if the notary ack/aff is on a separate page and no reference to the document it goes with, I print under my section what document it goes with and file number and initial it.
Laura Biewer CA
01:00:14
Embosser is raised seal with no ink with your notary info and can be used alone in some states or as optional safeguard
Lisa Kadle
01:00:32
When there are blanks in a loan package do we ask the lender to fill them in before the signing?
Aileen McGorty
01:00:49
where to do get such stamp?
Jamie Liggins-notaryaccess.org
01:01:41
@Annie... EXACTLY and thank you
Jamie Liggins-notaryaccess.org
01:02:17
I say staple and follow the suggestions mention on safeguarding
Laura Biewer CA
01:02:18
CA requires staple to attach cert
Lundria Blair
01:02:41
FL can do copy certifications except the vital stat docs.
Jamie Liggins-notaryaccess.org
01:03:30
Back up what Laura said...know your state specific notary laws
Dr. Kerry Duskin
01:06:42
In Louisiana you can do just about an attorney can do except go to court.
Annie -Tennessee
01:07:50
How interesting what Louisiana notaries can do!
Yvonne Sidell
01:08:10
@ Dr Kerry....wow that is interesting to know :)
Annie -Tennessee
01:08:13
But also the burden of responsibility...
Jamie Liggins-notaryaccess.org
01:09:13
yes we call ourselves paralegals in a sense
Annie -Tennessee
01:09:29
Ergo the need for webinars like this and investing in ourselves as notaries!
Annie -Tennessee
01:10:34

this is similar like patriot act form.... you are signing as signing agent or company representative not as a notray
Anita Flickner

When I was naturalized many years ago I was told no-one can even ask for a copy of my certification.

Aileen McGorty

Galaxy A21, the best practice is only using MiLona or consult an attorney. What I have seen is that MiLona isn't very clear or straight forward. I honestly use my Bank Security Act training in most things if I'm uncertain. I'd rather tell a client that I am not familiar with a document or my authority to notarize it than lose my commission
Laura Biewer CA

I always get a thumbprint, but I am CA, Don't do it in MT or in some other states where statues state no.

I have found people ask if you will read it is because they can not read English and don't want to tell you

01:52:39
Can we have a zoom meeting on Notaries working as Digital Court Reporter? This is another avenue for Notaries. I am a transcriber for Court Reporters. There is a shortage of Court Reporters, so Digital Court Reporters are becoming prevalent.
Charmayne Shirley
01:53:02

01:57:36
Bill - if we check documents and see one initial missing from one page and we have a copy of that document. Can we call the signer and go back right away? Or do you have to schedule a whole new appointment and do it all over again?
Dantrell Sims
01:57:39
Accountability!
Jennifer Rogers
01:57:42
I use signature stickies and book sticky tabs with notes on what is needed. It may take some extra prep time, but worth it...and yes, I check a few times as well.
Bill Soroka
01:57:59
Absolutely! Catch a mistake? Reach out and try and fix right away
Natalie Mayer
01:58:50
great thanks!
Dr. Kerry Duskin
01:59:39
When doing a signing and the document don't ask for a stamp do you stamp anyway with your signature?
Dantrell Sims
01:59:46
Get some tennis rackets and put them on your feet if you have to
Lee V
02:00:22
as a new agent - do they send me a pre paid lable to return docs? or do I pay
Gwendolyn Johnson
02:00:53
they paid
Aileen McGorty
02:02:04
I have a question, in attorney states, when you have the buyer attorny at the closing and you are representative of the Bank, who should conduct the closing? any advise? This happened to me last week and the buyer attorney missed a few things and I steped in
Lee V
02:02:22
do I need a scanner? I just have a laser printer.. new agent
Shelbey Hogan
02:03:44
Once I have the receipt, I then send it to the signing company in an email
Jennifer Rogers
02:04:04
Hi Lee, yes, invest in a scanner. I just bought a mobile scanner...it's an Epson and it has wifi that you can loop up with hotspot, plus, I have a scanner on my laser printer
Gwendolyn Johnson
02:04:12
I suggest you get a scanner
Annie -Tennessee
02:04:21
Question: I've come across the passport affidavit form (for when one of the parents can't come in person to the appt). It indicates to stamp that doc with the notary's seal. But there's NO notarial certificate wording. Why would a federal doc do that?
Cherise McGautha
02:05:30
I can scan on my iPhone, will that suffice? Has anyone scanned from their iPhone? -New agent
Jennifer Rogers
02:06:32
I use square appointment, which is embedded on website and after every confirmed appointment, I block off time between appointments for travel and also courier delivery
Dantrell Sims
02:06:33
I don't understand how you forget about your job
Candace Stefflre
02:06:40
and don't do it again!
Luis Rivera
02:06:54
a few notaries on one of my FB notary groups said they scan using their phones
Dantrell Sims
02:07:31
That's good advice Jennifer!
Kim Flanagan
02:07:45
I bought bright green envelopes for that reason!
Lundria Blair
02:08:18
For checks, I either paperclip to the cd or alta or staple if title requires that.
Lucretia Jones
02:08:22
color envelopes is a great idea! never thought about that.
Christina Irizarry-Torres
02:08:35
@kim big envelopes or small envelopes.
Kim Flanagan
02:09:51
Just standard envelopes to attach to attach to the front of the stack, so that it stands out. I write in black sharpie, "Check Enclosed!" or something to that effect
Aileen McGorty
02:10:12
I agree.... Tye me tool....
Dantrell Sims
02:11:20
I believe they definitely should have a general understanding of what their signing, but some people just sign anything all willy nilly
Donna Miss
02:12:25
As my daughter did with the purchase of her new home. She just wanted to sign and I kept slowing her down to understand what she was signing.
Dantrell Sims
02:12:54
Yeah you don't want to turn a 30 min appt into a 2 hour appt
Luis Rivera
02:14:18
Dr. Kerry had an interesting question earlier. "When doing a signing and the document don't ask for a stamp do you stamp anyway with your signature?"
Dantrell Sims
02:14:35
Lol!
Jennifer Rogers
02:15:46
A good example, but in reverse, when my sister bought her home, it was under a VA loan. The closeout numbers were wrong, at a loss to the lender. The loan had already been funded for months and they tried getting her to redo the loan. The JAG unit told the lender, too bad, your loss. Not that a notary would be at fault, but it illustrates the importance of checking your paperwork
Soni Truelove
02:16:08
Lol!
Cherise McGautha
02:16:44
HaHa!
Bill Soroka
02:17:17

Laura Biewer CA
02:21:04
Natalie, call your hiring company so they can schedule another notary
Gwendolyn Johnson
02:21:04
You have to get in touch with the lender
Dantrell Sims
02:21:18
Lol!
Clyde Heppner
02:21:18
@Natalie contact the company who hired you and let them know the appointment needs to assigned to another notary. No issue. It happens.
Dantrell Sims
02:21:44
