How do I perfect an appeal from a Civil Court decision to the Appellate Term? Specifically, 1. how to I

33:41
Austin Mann, UB Law Student, Empire Justice Center

33:56
Can you provide us with information on where to direct folks to access the Skype Help lines, etc., just noted?

34:33
Do you expect that TOPs will extended again in June?

36:35
Please email any materials to me at blaustone@law.cuny.edu Thank you.

36:48
Coronavirus Telephone Hotline: 833-503-0447

37:29
should these letters be filed with the police dept?

37:48
@rochelle - is this number for skype help or for litigants with court appearance questions?

38:12
I usually have my client file a copy of their orders of protection with their precinct

38:23
Was this mailing sent out from Family Courts in NYC?

40:18
Specifically, as I prepare my Reproduced Record, -- 1. how do I view the Civil Court record so that I can certify my record is a true and accurate copy? and 2. how do I get the clerk's return? 3. how do I perfect, i.e. how do I file my brief, clerk's return and reproduced record? Clerks have given mixed advice, incl that we just have to wait until court opens up again.

40:19
Coronavirus Telephone Hotline: 833-503-0447 is not a skype help number. This is the general information number that Christine mentioned that her staff answers. I believe it's for any questions.

40:51
General question - Have you worked with Microsoft so that they don't upgrade you to Teams coexistent mode, where SFB only works in reduced functionality, as they have with other companies?

40:55
This might cause some confusion because there are virtual conferences that are being scheduled.

41:45
What about cases scheduled recently during the shut down - are they also being postponed now?

42:05
How did you publicize the existence of the Skype-Help number? Have litigants been using this service?

42:11
We filter out any cases that we identify as being held virtually.

42:31
Or held as part of emergency matters.

43:39
How do you manage the use of an interpreter during a video court proceeding?

45:11
?||[

46:23
l;l

46:24
Do you advise that we "practice" with our attorneys to use TEAMS to be well prepared for a possible change?

48:04
There has been some confusion on the question of whether new cases can be filed in situations where e-filing is not available. For example, new non-emergency family court matters? Do they get filed through EDDS or some other method. You may be getting to this later in the presentation....

48:44
In repairs cases in Housing Court: Are virtual hearings a default? Or do tenants have to request them?

49:15
what is the link to file via edds?

49:50
Our next presenter will talk about EDDS

49:57
great, thanks!

50:02
I have the same question as Joanne re filing in Housing Court.

50:03
Great. Thanks.

51:20
How can the parties obtain a copy of the audio recording of a virtual appearance on Skype for Business? Is the audio recording automatically transcribed?

51:37
I filed an OSC for an emergency housing case. The court should have given me a handout to serve with the signed order about appearing virtually, but did not. I had to provide opposing party emails and phone to the court who then tried to loop them in on the day. Luckily I was in touch with the opposing party, but it would have been terrible it I hadn't been able to reach them and my client's emergency illegal lockout hearing may have been delayed. Please consider giving litigants a handout on virtual appearances to serve on opposing parties along with signed OSCs so that emergency proceedings are not delayed and so that pro se parties are not disadvantaged in this particular way, thank you.

53:11
In repairs cases in Housing Court: Are virtual hearings a default? Or do tenants have to request them?

53:52
We are finding that many court appearances are actually attorneys only conferences where things are not recorded.

54:15
Thanks Rochelle!

I noticed a few weeks back that categories of documents within NYSCEF was more limited than previously. In Queens Supreme, couldn't find interrogatories, notice of ___ (production of documents), affidavit of service - even though other existing documents had been filed as such. Not sure if the list has since expanded.

01:04:54
can't be used to commence matters-- can it be used to file amended petitions or subsequent petitions in an already pending matter

01:05:07
claunickd@camba.org

01:05:48
If EDDS can't be used to start cases and NYSCEF is not available on the certain category of cases - how does the court want us to file new cases?

01:05:55
jeffreya@camba.org

01:06:38
The AOs state that pro se litigants can still file and serve by non electronic means but many clerk’s office are still closed to the public and rejecting certain types of filings. How is this being reconciled? Additionally, if a pro se litigant is forced to file electronically, how do they ensure their right to still opt out of efiling and right to be served by paper in the future is protected?

01:07:06
salazars@raffbecker.com

01:08:12
If you file through NYSCEF but accidentally misclassify documentation and clerk rejects will the case or filing be considered as filed resulting in all parties to be served ?

01:08:13
Are certain PDF types required or will any PDF document work?

01:09:32
what about town and village courts? Do they accept EDDS?

01:09:33
In Brooklyn Criminal Supreme EDDS system, there is a box we can check to have the document filed with the court. We were told that DOES count as filing with the court. Is that not accurate when you previously said EDDS does not allow us to file with the court?

01:09:36
Where can you file an RJI? Will the case get assigned to a judge? — if you are commencing a new action, do you need to have a consent to e-file in advance of filing?

01:13:10
What is required for service for a clerk to accept a pro se document for filing?

01:14:13
what about exhibits attached to otsc?

01:16:19
Are there plans for courts using EDDS to transition to e-filing? For example, in NYC Housing Court this was recommended 2 years ago by the Special Commission. Is there any information about this?

01:16:57
is this a home grown system? What if another court system would like to adopt it?

01:18:09
Home grown.

01:19:01
Is there a centralized place for documentation about all of this? A website, portal, something?

01:22:45
For divorce cases commenced in counties where MATS could not be filed thru NYSCEF, but are now settled and final papers need to be filed, how should those final papers be filed?

01:22:58
The unrepresented litigants I work with are required to opt-out of efiling, in cases of efiled matters in order for the court to accept their paperwork.

01:23:01
To the extent it is possible, I would definitely like to see EDDS used for new filings.

01:23:45
For family court - not necessarily for other types

01:23:46
Just to clarify, Right now EDDS cannot be used to file new family court petitions?

01:24:02
NYSCEF - New York State Courts E-filing

01:24:16
EDDS - Electronic Document Delivery System

01:24:36
When a Supreme Court case was filed before NYSCEF was activated in a county, and the parties plan to file a stip and consent to efiling through EDDS now that NYSCEF is in their county, how are the parties advised when they can file NYSCEF in that case, and how long does it take before they get notice?. ie is it immediate or does the request have to be approved?

01:24:43
will this webinar be available for watching again and or through OCA site?

01:24:52
Are non-represented parties assisted with petition preparation for family court matters? For example in an initial child support or custody matter.

01:24:55
under Document Type in EDDS, there is no choice For Notice of Appearance or other . . . will this drop down expand?

01:25:32
The webinar is being recorded and will be posted on the Permanent Commission and IOLA websites. Likely by Friday.

01:25:34
This webinar is being recorded and will be available here: https://ww2.nycourts.gov/technology-initiatives-29451

01:25:47
and available here: www.iola.org

01:25:57
Surrogates Courts?

01:28:48
Under EDDS is there a way for someone to view filed documents?

01:28:51
To clarify regarding pro se filing answers--in civil court, litigants do not have to serve them (the clerks do so). But now they do, under EDDS?

01:30:10
what about eg. Kings Supreme is NYSCE F but the case is not an efile case. How to move or file proposed orders

01:30:55
What if I send my document through EDDS on filing deadline, but document isn't filed by court until next day - has my client missed their SOL/deadline?

01:31:10
will this be available on demand? to play and watch later?
