so does this apply to people on pension tax credit
Mike Smith

These cases always depend on the facts of the case. Is the main issue:1. They included discriminatory factors in their financial assessment policy2. They amended an existing policy to capture more people and the effect of that was discriminatory; or3. They failed to conduct a proper equality impact assessment (and therefore by implication if they had done the EIA properly they would have been okay

Hi It would be helpful if people put the questions in the Q & A which can be found on the toolbar

Congratulations on the campaign from Kevin in Hammersmith & Fulham - after our long struggle, including legal challenge, against charging local Disabled people for essential support and services, we are now the only authority in England not too charge. The Council has not charged since 2015.

Is it just people on the higher living rate of PIP and in the ESA Support Group? Can they do it with other disability benefits and rates?
Kevin Caulfield

Campaigning led directly to the policy change.

Hammersmith & Fulham reamain an inspiration! Unfortunately disabled people in many areas have not got their campaigning act together yet

Tower Hamlets also didn't charge for years up until two years ago. Even under a Labour administration they started then. But that was because central government funding is so unrealistic. I think this is going to get worse and worse, across the country, for the next three years and we have to find a way to join together rather than fight LA by LA
Joseph Healy
50:23
I agree Mike. The question is how to force it on the LAs. Do you have to threaten them with individual court action or should it be enough to quote this judgement?

This is a tremendous victory and so good too to have today's webinar about it.

In Lambeth they give £25 base level. But they will only allow people to claim extras if it was mentioned n their Support Plan. So that’s the rub because most people won’t have it in the SP.

Thanks, Jon, for inviting me to give contact details for Liberation. You can contact Liberation at liberationrights@gmail.com It would be tremendous if you can get in touch with me about our campaign against serious human rights breaches in the forthcoming Mental Health Act White Paper, including serious concerns about continued institutionalisation.
