One of the disappointing facts about the proposed Code of Conduct is that it TOTALLY GUTS any statements about expected behavior from the Code of Conduct. That on its face is a bad idea.
David Uebersax
01:40:45
Good point about Recall, because PAID Electeds seem to have a higher threshold for being involuntarily removed (notwithstanding their Party leadership twisting arms of removing Committee appointments).
Tony Wilkinson
01:44:17
The basic principal is that BOARDS have the collective responsibility to maintain a safe workspace. We need to be expecting that EVERY board member should be speaking up to correct obvious bad behavior in their own room. The first step should not be an 'appeal to authority". How about our own personal responsibility to speak up?

Re the data vulnerability, I've looked a little bit more and it appears to me that they are individually going through and removing data from each of the ~1800 records instead of plugging the hole. Another question (and I will get some push-back on this) is what is the "crime" which is being alleged. The truth is we are in a movement that is trying to make formerly protected (though reprehensible) speech into a criminal act. The old "sticks and stones" saying no longer applies today. I don't believe the 2013 Work Group recommended Board member removal unilaterally WITHOUT DUE PROCESS
Miho Murai, HCNNC
02:45:10
Hello all!! The majority of our board members have been meeting in person throughout Covid and participating in the zoom meeting by phone with one or two phones. They will not let all Board Members (such as me and about four of us) know where they are meeting and they will not use video. I do not believe where they are meeting is ADA approved. Our Board is also one that Commissioner Shaffer referenced where Committee Chairs are not able to have their requested agenda items placed on the Board agenda for further action. For example, I am the Chair of Schools and Libraries and have been trying to organize an Education Town Hall Meeting but since it has not been placed on the agenda, we cannot hold the event. I really do hope we can better enforce Code of Conduct violations while balancing members' rights to due process
Tony Wilkinson
02:48:05
Frankly (I am going to get in trouble), it is the BROWN ACT that is being violated in Historic Cultural. If the city is not going to correct this (and they have a history of failing to act in this case), the next step is to complain to the DISTRICT ATTORNEY, who enforces the Brown Act.
David Uebersax
02:48:52
That's really alarming Miho...

Miho, the board members in this case are violating the Brown Act. However, a complaint must be registered with the board within 30 days of the violation. After 30 days, their actions become valid.
Tony Wilkinson
02:54:03
Until it is replaced, we have the EXISTING Code of Conduct. It still (until the gutted version is approved) has specific behavior prohibitions that need to be enforced.

I had a Board Member removed for lapsed Code/Training, in October. Rather than reinstate, he ran for (re)election, and was voted back in along with new members. But then, faced removal from the OLD term's 'Grace Period', as opposed to his fellows newly elected.
Tony Wilkinson
