Landlords always seem to tell tenants that in order for them to do something the tenant will HAVE to go to Housing Court and write a letter complaining about the offending tenant. This usually puts the tenant in danger and they are understandably afraid to exercise their rights. Do courts really require the tenant to show up and/or write letters?

If they need any help talking through what's reasonable and what's not, and what to do about it, they may want to reach out to their local CDRC before filing a housing court claim for nuisance. Sometimes, it can be worked out without the need for a court case.

If a tenant doesn't have a case yet but would like to submit a declaration, do they send it to their landlord, the court, or both?

I have a client/ tenant that has completed and mailed the declaration. Will they receive a response back in the mail of the pending case being on hold until May 1st.?

If a tenant doesn't have a pending case, would they submit the declaration directly to the landlord? Getting a hold of a landlord's address can be difficult.

Does this form also work for NYCHA tenants? Or are they subject to a different process?

High Earning Tenant has been ghosting small landlord since June 2020 and owes 7 months back rent.....90 day sublease notice sent via certified mail and sublease will not be renewed and moratorium is in effect.,.....this is such an unfair situation that landlords are dealing with...
