37:09
smoking in rent stab apts

37:40
great they should be evicted

38:28
Landlords always seem to tell tenants that in order for them to do something the tenant will HAVE to go to Housing Court and write a letter complaining about the offending tenant. This usually puts the tenant in danger and they are understandably afraid to exercise their rights. Do courts really require the tenant to show up and/or write letters?

38:41
If they need any help talking through what's reasonable and what's not, and what to do about it, they may want to reach out to their local CDRC before filing a housing court claim for nuisance. Sometimes, it can be worked out without the need for a court case.

39:47
environmental racism by smokers

48:26
Is this form on the internet?

49:07
would this be late fees previous to covid 19

49:24
Does this declaration apply to ejectment actions in supreme court?

52:03
Have these declarations already been mailed to people?

52:06
Thank you

53:47
If a tenant doesn't have a case yet but would like to submit a declaration, do they send it to their landlord, the court, or both?

53:54
I have a client/ tenant that has completed and mailed the declaration. Will they receive a response back in the mail of the pending case being on hold until May 1st.?

54:53
If a tenant doesn't have a pending case, would they submit the declaration directly to the landlord? Getting a hold of a landlord's address can be difficult.

55:10
Does this form also work for NYCHA tenants? Or are they subject to a different process?

55:26
my apologies if I’ve missed this but do tenants HAVE to send the form back to the courts? Ive heard information about tenants giving this form to there landlord.

55:39
Is there an official statement from the State that says there is no moratorium on rents

56:05
Does the tenant have to prove their hardship in court after filing the declaration?

56:13
It was about a nuisance tenant case

56:13
can you include PEU MOPT in your resource that you are providing

57:33
In regards to late fees, are they still on hold due to the moratorium?

58:54
Are all legal agencies assisting tenants in filling out the affidavit of hardship declaration?

59:14
is there a number that renters can call to get the HD due to lack of internet

01:00:07
if tenant is undocumented- income might not be on record -should tenant still complete form

01:00:39
How about Mitchel Lama tenant? Can they also fill out the form?

01:02:15
I would suggest that the HD be sent certified mail to landlord

01:03:40
If they don't have to prove their hardship what prevents tenants from simply just checking off a box without it being true?

01:03:43
If the landlord gave you a tenant termination letter to vacate the apartment and tenant is current on rent however can't vacate the apartment for financial reasons not having money to move

01:03:49
how would the governing agency determine if the applicant has truly experienced a hardship?

01:04:22
If a tenant has an assigned GAL would the declaration have been sent to GAL or the tenant?

01:04:59
Go to the Library for internet access

01:05:01
Upstairs neighbor is making noise. The ll says I can't do anything to the upstairs tenant unless the tenant below is willing to go to court and write a letter of complaint when I do a holdover. This puts the tenant below in danger. is it true that the court requires the tenant below, to show up in court and write letters?

01:05:01
does 311 have capacity to send physical forms?

01:05:33
thanks great question T

01:06:57
Is it improper for a landlord to send a notice to vacate letter to a tenant if the lease is still active? If so, would the LL have to wait till the lease is over?

01:07:05
#cancelrent

01:08:09
with the disparity in inflated rent and so many LL's going into foreclosure wouldn't it be good to have universal rent structured laws?

01:09:37
maybe people dealing with noise complaints should be seeking mediations

01:09:59
the New York peace institute provides mediation services

01:10:08
would video or audio recordings of the nuisance be a way of proving a nuisance by neighbors?

01:10:25
sue landlord in hp for harassment if they refuse to evict noisy neighbor

01:11:16
Hi Tranae! Yes, we do offer mediation and I have other colleagues on here too offer mediation services!

01:12:50
you guys are appreciated nick! thank you

01:14:38

01:14:42
High Earning Tenant has been ghosting small landlord since June 2020 and owes 7 months back rent.....90 day sublease notice sent via certified mail and sublease will not be renewed and moratorium is in effect.,.....this is such an unfair situation that landlords are dealing with...

01:15:11
