OSHA's LEP for Midwest Food Manufacturers

OSHA is now conducting inspections in Illinois (and Ohio) as part of a new Local Emphasis Program (LEP) for the Food Manufacturing Industry announced in late 2022. This LEP empowers Illinois OSHA offices to inspect food manufacturing and processing sites with a focus on machine guarding hazards, the employer’s hazardous energy control (LOTO) program, and the sanitation program (hazard communication and Group LOTO). OSHA has the ability under this LEP to conduct inspections for all referral and complaints, formal or non-formal, which contain allegations of potential worker exposure to serious hazards associated with operating food production machinery or performing service, maintenance, and sanitation tasks on food processing and ancillary equipment.

Establishments can be selected for an inspection even if they have an exemplary safety record, have not been the subject of any complaints, and have not recently reported a serious incident. Join us for this discussion about what to expect and how to prepare your company for an OSHA inspection.

Attendees will hear directly from FDR Safety’s Steve Hawkins, former Head of Tennessee OSHA, and Aaron Gelb, Head of Conn Maciel’s Midwest OSHA Practice. Together they will answer the following questions:

• What is an emphasis program?
• How do programmed inspections differ from accident and complaint-based inspections?
• Which NAICS codes will be targeted?
• What happens during an LEP inspection?
• Which aspects of your operations draw the most scrutiny?
• What hazards are seen most often in food manufacturing?
• How should employers prepare for LEP inspections?

Attendees will be given a checklist they can use to self-assess key compliance aspects of their safety and health programs to better prepare for an OSHA inspection.

Gelb (Partner, Labor • Employment and OSHA • Workplace Safety Practice Groups, Conn Maciel Carey LLP ) Aaron R. Gelb is the partner in charge of Conn Maciel Carey’s Chicago office and leads the firm’s Midwest OSHA practice, representing employers during inspections, investigations, and enforcement actions involving fed OSHA and state OSH programs. In addition to managing the full range of litigation against OSHA, Aaron reviews safety policies and procedures, manages audit programs, and helps develop and present training on a variety of topics. Aaron serves as the primary workplace safety and health education provider to the Illinois Manufacturers Association and is a frequent speaker on such matters throughout the United States. Aaron also has extensive experience litigating equal employment opportunity matters in federal and state courts, having tried numerous cases to verdict and defended employers before the EEOC as well as fair employment agencies nationwide. Ashley D. Mitchell (Associate, Labor • Employment and OSHA • Workplace Safety Practice Groups, Conn Maciel Carey LLP ) Ashley D. Mitchell is an Associate in the Chicago office of Conn Maciel Carey LLP supporting both the OSHA and Labor and Employment practice groups. Ms. Mitchell represents and advises clients in a broad range of employment issues involving the employer-employee relationship including wage and hour disputes, Title VII discrimination claims, and compliance with the Americans with Disabilities Act (ADA). She also provides advice and guidance on responding to workplace safety complaints and litigating contests of OSHA citations. Steve Hawkins (Chief Operating Officer of FDRsafety and Former Head of Tennessee OSHA ) Steve Hawkins is currently the Chief Operating Officer of FDR Safety LLC. He began his employment with FDR in March of 2020. Steve previously served as the Deputy Commissioner of the Tennessee Department of Labor and Workforce Development and as the Assistant Commissioner for Tennessee OSHA for seven years. In his role as Deputy Commissioner, he managed Tennessee OSHA, the state Unemployment Insurance System, and the Workplace Regulation and Compliance Division. Prior to joining FDR Safety he began his career with the Tennessee Department of Labor and Workforce Development in 1986 as an Occupational Safety Specialist in TN OSHA. He was promoted to area office Safety Supervisor, Safety Compliance Manager, Assistant Administrator, Assistant Commissioner, and most recently, Deputy Commissioner of the department. Steve served as the department’s representative to the Tennessee Emergency Management Agency (TEMA) and the Tennessee Emergency Response Commission.
