Description
As we move into the second half of President Biden’s first term, OSHA is turning up the heat on the rulemaking gears. The next two years may see the most active rulemaking period in the agency’s history – lead, heat, infectious disease, LOTO, PSM, E-Recordkeeping, HAZCOM, COVID-19 for Healthcare, etc. … and the list goes on.
Join us for a lively discussion of OSHA’s rulemaking agenda, a refresher on the OSHA rulemaking process generally, and our take on the agency’s true rulemaking priorities and significant changes of which you should be aware. We also will discuss state agency rulemaking activities of note and how those differ or align with the equivalent federal regulatory programs.

Kathryn M. McMahon is a partner in the national OSHA • Workplace Safety Practice Group of Conn Maciel Carey LLP. She focuses her practice in the areas of occupational safety and health (OSHA) law and environmental law. Ms. McMahon helps clients manage incident and fatality inspections, and litigation related to alleged violations by federal OSHA and state OSHA programs. She also represents industry stakeholders in all aspects of OSHA rulemaking, including proposed rules regarding silica, injury and illness recordkeeping, hexavalent chromium, and beryllium, among others.

Lindsay A. DiSalvo is a partner in both Conn Maciel Carey LLP's national OSHA • Workplace Safety Practice Group and Labor and Employment Group, where she focuses her practice on all aspects of occupational safety & health law. Ms. DiSalvo represents employers in inspections, investigations and enforcement actions involving OSHA, the Chemical Safety Board, MSHA, EPA and state and local safety related agencies. She also handles all aspects of OSHA litigation, from criminal prosecutions to appeals of citations.

Beeta B. Lashkari is an associate in the Washington, DC office of Conn Maciel Carey LLP working in the OSHA practice group. Ms. Lashkari is a former Attorney-Advisor at the Chemical Safety Board (CSB), and advises and represents clients in a wide-range of inspections, investigations, and enforcement actions. Additionally, Ms. Lashkari manages workplace investigations by OSHA, CSB, EPA, and other state/local regulators, defending employers, as well as counseling clients, developing/reviewing safety policies, and providing compliance advice on myriad legal issues employers face in the workplace.
