Process Safety Update: The Latest with OSHA PSM & EPA RMP
Description
Nearly two full years in, and the Biden Administration has been making its mark in the process safety arena, rolling back the rollbacks of the RMP Rule promulgated during the Obama Administration, and dusting off the PSM reform rulemaking that had begun at that same time. The CSB has also been changing the process safety landscape with new guidance about its Accidental Release Reporting Rule and other investigation activities.
We are also pleased to announce that we will be joined by a special guest co-presenter, Mr. Clyde Trombettas. Mr. Trombettas recently-retired from Cal/OSHA as the Program Manager for Cal/OSHA’s Process Safety Management Unit. He will be providing an update regarding Cal/OSHA’s PSM team, enforcement trends, and other PSM regulatory developments.
This process safety regulatory update will:
• Review the status of OSHA’s and EPA’s process safety rulemakings;
• Discuss the data from and new guidance about CSB’s Accidental Release Reporting Rule;
• Analyze other process safety related developments at OSHA under the Biden Administration; and
• The latest with Cal/OSHA’s PSM program

He focuses his practice in the areas of occupational safety and health (OSHA) law. Mr. Smith represents clients in the full range of OSHA-related matters across a wide range of industries, and works with his clients to identify safety and health strategies that both increase employee safety and improve business performance. Beeta B. Lashkari (Associate, Labor • Employment and OSHA • Workplace Safety Practice Groups, Conn Maciel Carey LLP ) Beeta B. Lashkari is an associate in the Washington, DC office of Conn Maciel Carey LLP working in the OSHA practice group. Ms. Lashkari is a former Attorney-Advisor at the Chemical Safety Board (CSB), and advises and represents clients in a wide-range of inspections, investigations, and enforcement actions. Additionally, Ms. Lashkari manages workplace investigations by OSHA, CSB, EPA, and other state/local regulators, defending employers, as well as counseling clients, developing/reviewing safety policies, and providing compliance advice on myriad legal issues employers face in the workplace. Clyde Trombettas (Process Safety Specialist, Phillips 66 ) Mr. Trombettas recently retired from Cal/OSHA as the long-time Program Manager for the agency’s Process Safety Management Unit. As Program Manager, Mr. Trombettas led implementation of policy decisions on refinery safety, including general industry and construction safety standards, and oversaw regulatory revisions and edits to existing process safety and risk management programs. He regularly engaged with stakeholders in the health and safety community, responded to industry questions on implementation of new regulations, and ensured flow of hazard information from highly hazardous facilities to other agencies and the public. He also coordinated Cal/OSHA’s PSM-related operational and enforcement activities and regulatory priorities with federal, state and local government officials, and represented Cal/OSHA before various stakeholder groups. After leaving Cal/OSHA, he returned to work for Phillips 66, currently as a Process Safety Specialist in CA.
