If you have non-exempt hourly employees, you have state and federal requirements to calculate their overtime or any meal or rest break premiums and Paid Sick Leave using regular rate of pay. This is not the base hourly rate, but an often-complicated calculation that may change from week to week. Serious penalties and back pay are rendered for miscalculations.
