Title IX Hearings Under the New Regulations: Essential Elements, Pitfalls, and Best Practice
The webinar will present a detailed look at the prescriptive requirements related to live hearings under the final Title IX regulations, including key elements related to questioning by a party’s advisor, determining relevance,  limitations on the use of statements not subject to cross-examination, and providing an advisor to conduct questioning at the hearing.  The webinar will include reference to language  in the Preamble to provide insights about implementation of these core provisions, and will discuss effective practices that balance legal compliance with compassion and care.

Gina Maisto Smith
Gina is the chair of Cozen O’Connor’s Institutional Response Group and the founder of the nation’s first practice dedicated to the institutional response to sexual and gender-based harassment, violence, child abuse, elder abuse, other forms of discrimination and harassment, workplace misconduct, and criminal conduct. Gina provides consulting, counseling, and legal advice on all aspects of the institutional response to misconduct. She assists institutions in designing effective institutional responses that integrate the complex federal and state regulatory framework with the unique dynamics of interpersonal misconduct and its impact on individuals, institutions, and communities. Gina is frequently called upon to advise institutional clients including presidents, boards, senior management, and counsel on the intersection of trauma-informed, fair, and impartial processes with the intersecting legal landscape.
Leslie Gomez
Leslie focuses her practice on the institutional response to sexual and gender-based harassment and violence, child abuse, and other forms of harassment, discrimination, and criminal conduct. Leslie provides consulting, counseling, and legal advice on all aspects of the institutional response to misconduct. She assists institutions in designing effective institutional responses that integrate the complex federal and state regulatory framework with the unique dynamics of trauma and the impacts of interpersonal violence on individuals and communities. Leslie regularly advises presidents, boards, senior leadership, counsel, student affairs, human resources, campus law enforcement, Title IX Coordinators, and other campus partners in implementing trauma-informed, fair, and impartial processes.
