In June 2021, the U.S. Department of Education issued a Notice of Interpretation saying that the Office for Civil Rights will enforce Title IX regarding discrimination based on sexual orientation and gender identity. This session will provide participants with the legal knowledge and practical know-how to address these sensitive and often complex issues in the course of processing a complaint. Topics discussed include:
• Discussion of relevant terminology and legal theories, including free speech, freedom of religion, and academic freedom
• Updates on relevant case law and administrative decisions, and
• Review hypothetical examples addressing misgendering/deadnaming, access to gendered facilities, and in-classroom discrimination complaints, among other issues.
