Unanchored Verdicts: What to Do and How to Handle it When Plaintiff Counsel Waives Medical Specials the Day Before Trial

This panel will address the latest plaintiff bar technique of presenting the plaintiff’s case without economic damages. Panelists will discuss how to handle the case in pre-trial, and at trial, when plaintiff counsel “waives” economic losses, or waives medical bills/medical specials. We will also explore the psychology of the “unanchored” approach, including how to respond to such a claim, and how to “anchor” a jury from the defense perspective, including what to do during key portions of the trial (discovery, pre-trial, voir dire and during trial).
