When it comes to strategies being used to get a buyer’s offer accepted, one of the hottest topics and one of the most controversial tactics is the “Dear Seller” letter. Buyers have written emotional pleas, submitted photos and videos, and made their best case about why the seller should choose to accept their offer. Problems can arise if the buyer’s personal communications appeal to the seller based on protected class characteristics. If the seller picks an offer or rejects an offer based on protected class characteristics of the buyer, there is a risk of liability for all involved.
