Administrative Challenges of SECURE 2.0
Description
SECURE 2.0 was enacted as part of the 2023 Consolidated Appropriations Act, which was signed into law on December 29, 2022. Now that the dust is beginning to settle, the more than 90 provisions addressed by the new law must be implemented.
While most SECURE 2.0 provisions deal with defined contribution (DC) plans, there are some that apply to defined benefit (DB) plans as well, and there are even a few that only affect DB plans. All – whether directly or indirectly – can affect the overall retirement security of plan participants, regardless of which type of plan applies to them.
Some changes may require amendments to existing retirement plans and offerings. Some may require changes and upgrades to administrative systems and communications to plan participants before the effective date of the changes. All will underscore the need for accurate and readily available information.
In short – particularly when you combine all of this with the need for technical corrections to dozens of provisions of the new law -- the overall outcome can pose serious administrative challenges.

In her role as Operations Officer, Ms. Feser oversees all aspects of benefit administration, including survivor, disability, and retirement benefit programs. Ms. Feser is also responsible for oversight of the employer, production, and pension services; member and retiree services; and support services divisions of the System. At the forefront of Ms. Feser’s responsibilities are cost effectiveness measurement for all activities of the System and policy issues related to the public safety sector of public employment. She is on the Steering Committee and has been involved in data management and the RFP process for the new Pension Administration System project. Michael Kreps (Principal, Chair Retirement Services Practice @Groom Law Group) Michael Kreps is co-chair of Groom’s Retirement Services & Fiduciary Group, and he works with a wide variety of clients on complex retirement and health plan issues. His firsthand experience with the legislative and regulatory process gives him a perspective that is often instrumental in helping clients develop and implement effective compliance and advocacy strategies. Michael advises many of the country’s largest benefit plans and service providers on issues related to plan governance, administration, funding, and restructuring. Michael is an expert on benefit plan recordkeeping and the development of complex financial and insurance products. He also serves as fund counsel to some of the largest benefit plans in the country, including public retirement systems and VEBAs. Michael helps clients address complex pension funding challenges for both single employer and Taft-Hartley (multiemployer) plans, and he has been involved in over a dozen distress terminations before the PBGC. Jean Carlo Oviedo (New Business Development Manager @Pension Benefit Information) Jean Carlo Oviedo is a New Business Development Manager dedicated to Government accounts. A graduate of the University of California, Berkeley with a degree in Microbial Biology. Jean Carlo has a background in Sales and Account Management and joined PBI in September 2015. JC is responsible for the government sector and efforts to educate retirement systems in the United States about the serious issues with the Death Master File (DMF) and the solution that PBI can provide. Cindy Kushnir (Operations Manager @Wyoming Retirement System) Beginning her 30 year career at the State of Wyoming, Cindy served as a Member Benefit Specialist for WRS. She left WRS to embark on an Information Technology (IT) career with the Wyoming Department of Enterprise Technology Services. Cindy returned to WRS in 2015 to serve as the Business Integration Manager where she was responsible for IT, IT budgeting and contracting as well as managing the application development of the WRS Pension Administration System. After 24 years in IT, in 2020 Cindy was promoted to WRS Operations Manager where she is responsible for the Member Benefits section, the Employer Relations section and the Retiree Payroll section. Mike Bleakley (Deputy Director @Wyoming Retirement System) Mike Bleakley is the Deputy Director/Chief Financial Officer of the Wyoming Retirement System, where he oversees Member Operations, Finance & Accounting, Communications and Information Systems, as well as other agency-wide management duties assigned by the Director. He was previously the Staff Development & Executive Administrator for the Wyoming Retirement System where he managed personnel & leadership development, retirement board meetings, and governance matters including strategic planning, board policy, and legislative intent.
