How can we improve authors' contracts? Best practices and examples of collective bargaining agreements in France and Germany

Now more than ever, individual authors do not only face precarious working conditions, low and unstable income, but also a very weak bargaining position vis-à-vis their contractual counterparts.
In some EU Member States, music authors’ associations and their counterparts (in particular music publishers) have tried to address this situation by negotiating and signing collective bargaining agreements (CBAs). Those agreements - which also exist in other creative sectors - aim at promoting a more balanced and transparent framework for the contractual relationship between both parties.
As the 2019 Copyright Directive very much encourages such collective mechanisms, the objective of this webinar is to showcase different examples of collective bargaining agreements in France (with the “Code des usages”) and in Germany, analyse the lessons learned from those experiences, and encourage their development in Europe.

A member of the Compass Point All-Stars, he has recorded with Robert Palmer, Marianne Faithfull, Talking Heads, and others. He wrote for films Countryman, Kiss of the Spider Woman; directed and wrote for Jean-Paul Goude's French Bicentennial parade, and helped organise the Kora All Africa Music Awards. His solo work includes Words Of A Mountain and Echoes, featuring "Chief Inspector", "Mambo", and "Hi-Life". Wally joined Sacem's board of directors in 2012. • • Juliette started in the music business in 1988 at MINO MUSIC. She participated in the creation of ENCORE MERCI in 1995 where she became the Executive Director. Juliette has also been the Chairwoman of CSDEM since 2016. She was the Chairwoman of the French Production Music Association (ULM) until 2014 and has been its Vice-President since 2014. Juliette also initiated the Production Music Committee within ICMP and was its Chair until 2018. Micki Meuser • Katharina Uppenbrink (Film Composer & Music Producer - DEFKOM • Managing Director @ Initiative Urheberrecht ) Micki Meuser wrote music for numerous movies, including international feature films, for US - Canadian TV series, and many TV movies and TV series in Germany. He started into music in 1977 as a bass player with jazz legend Charlie Mariano and other well-known jazz musicians. Micki Meuser is currently president of the German Film Composers Union DEFKOM, on the board of DKV, and on the supervisory board of GEMA. • • Katharina Uppenbrink has been the Managing Director of Initiative Urheberrecht since May 2014. In 2002 she became Managing Director of the Verband Deutscher Drehbuchautoren (VDD). Her focus in this capacity was on copyright and film funding. She was appointed to various German Federal Film board committees. She helped to set up the Federation of Screenwriters in Europe (FSE) and played a leading role in the development of the World Conference of Screenwriters (WCOS) in Athens (2009), Barcelona (2012), Warsaw (2014) and Berlin (2018). Marc du Moulin - Moderator (ECSA Secretary General ) Marc du Moulin (France) joined the European Composer and Songwriter Alliance (ECSA) as Secretary General in June 2018. He has an in-depth understanding of the functioning of the creative sector and an extensive experience in European Affairs. He previously worked for the European Film Agency Directors, the Motion Picture Association, the European Commission (DG CNECT) and for Eurocinema. Marc holds a Masters in UK-EU-US Copyright Law from King’s College London and a Masters in European Studies from the Catholic Institute of Paris. He speaks fluently English, French and Spanish.
