In 2019 the Federal Government announced that the Fisheries Act has undergone significant changes that have been approved and given royal ascent. These changes enhance protection for all Fish and Fish Habitat and could have an impact on the DFO permitting process you may be working through on Municipal projects. These changes came into force on August 28, 2019 and apply to all waterbodies and watercourses that fish frequent at any time of any given year.
In short, the main changes include:
protecting all fish and fish habitats (previously only fish considered to be part of a Commercial, Recreational and/or Aboriginal (CRA) fishery were protected)
restoring the previous prohibition against “harmful alteration, disruption or destruction of fish habitat” (HADD)
restoring a prohibition against causing ”the death of fish by means other than fishing”
